NCIS and JAG star Zoe McLellan has been accused of kidnapping her own son in the midst of a custody dispute.

McLellan allegedly took her 4-year-old son Sebastian to Toronto with only 2 days notice to the boy’s father, McLellan’s ex-husband J.P. Gillain.

While a Canadian getaway with a primary parent isn’t too shocking, McLellan is actually moving to the city and is keeping Sebastian there with her, according to TMZ. She’s landed a role on the Kiefer Sutherland-starring show Designated Survivor and plans to live there for a year.

This, of course, is upsetting to Gillain. He’s accused her of forcing him to adjust to this new custody arrangement without choice. While she claims she will pay for Gillain to visit, he points out that their son shouldn’t be hastily moved because of an acting gig.

McLellan says she had no choice but to head to Toronto in a hurry and her position as primary guardian makes it okay for her to make the sudden move.

Gillain has asked for a judge to intervene in the situation and get Sebastian back home.

McClellan and Gillain’s relationship

McLellan is best known for her multiple roles in the JAG/NCIS TV universe. She played Petty Officer Jennifer Coates in the later years of JAG, and went on to play Agent Meredith Brody in NCIS and its spin-off NCIS: New Orleans.

Gillain is an actor himself, with small roles in the Matt Damon film The Informant! and shows like Castle.

The couple married in 2012 and Sebastian was conceived the first time the couple had sex.

“We got pregnant the first time we had sex,” McLellan said in a previous interview. “Pretty fast and furious.” 

The couple’s marriage did not stay steady for long after Sebastian’s birth. They separated in 2014, with McLellan filing for primary custody then.

Their divorce was finalized in 2016, with the actress paying Gillain a spousal support settlement of $30,000.

It was also reported that McLellan left NCIS: New Orleans to focus on spending time with her son after the messy divorce.
