DMX could be going to jail for visiting his family out of town.

The 46-year-old rapper is currently out on bail following his recent arrest for tax evasion. One of the conditions of his release was that he notified court officials if he planned to leave town. However, the "X Gon Give it to Ya" hitmaker failed to give the judge a heads up before leaving New York to visit family in St. Louis.

Murray Richman, DMX's attorney, spoke out about the incident saying that his client simply forgot about telling the judge his travel plans because he was preoccupied with the trip, according to TMZ.

Because DMX is accustomed to giving his probation officers notice when he plans to travel when performing shows, Richman says that this was uncharacteristic of him to forget. The possible repercussions for the issue might result in tightening restrictions for DMX such as making him wear an ankle bracelet. Richman plans to fight this in the event that his punishment is to wear an ankle bracelet.

In July, the "Party Up" rapper pleaded not guilty after being accused of creating accounts in other people's names and evading taxes by paying expenses in cash. The state also claims that he also filed a false affidavit in U.S. Bankruptcy Court, as he listed his income as "unknown" for numerous years.

The Internal Revenue Service says the total costs allegedly evaded equal up to $1.7 million.

After leaving the court, DMX, whose real name is Earl Simmons, remained positive in the situation. He said: "It's allowed me to not be scared of the situation and face it head-on, you know what I'm saying?" told THR. "My life is in God's hands."

This isn't X's first run-in with the law. His previous record includes a bevy of charges including drug possession, DUI, animal cruelty, possession of a weapon, failing to pay child support, and various driving charges.
